According to the United States Department of Justice, this act “prohibits discrimination by direct providers of housing, such as landlords and real estate companies as well as other entities, such as municipalities, banks or other lending institutions and homeowners insurance companies whose discriminatory practices make housing unavailable to persons because of:
The Fair Housing Act was enacted in 1968 to prohibit discrimination based on personal aspects people cannot control. Of course, not everything is quite so clean-cut as most laws are. Some people believe the Fair Housing Act is only applicable to those looking to buy homes. However, this isn’t the case. The Fair Housing Act is actually in effect for rental properties, the sale of housing, and the provision of mortgage loans. It is also in effect for most types of homes: houses, apartments, condominiums, etc. There are very few exceptions to this rule, such as in some senior housing or for private clubs. In the latter, the conditions that must be met are if you’re leasing apartments on behalf of the club and not for commercial purposes.
